SEC plans to appeal the Court ruling on Programmatic Sales remained the focal point.<\/p>\n<p>Reports of the SEC misusing Ripple\u2019s quarterly <a href=\"https:\/\/ripple.com\/insights\/q2-2023-xrp-markets-report\/?utm_campaign=&amp;utm_medium=organic_social&amp;utm_source=twitter\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">XRP Markets Report<\/a> continued to do the rounds on Sunday.<\/p>\n<p>Earlier this month, Ripple CEO Brad Garlinghouse had this to <a href=\"https:\/\/twitter.com\/bgarlinghouse\/status\/1686618130674774016?s=20\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">say<\/a> about SEC tactics in the SEC v Ripple case,<\/p>\n<blockquote>\n<p>\u201cWe began these reports to voluntarily provide updates given our XRP holdings. Sadly, they were used against us in the SEC lawsuit \u2013 however, we remain steadfast in our commitment to transparency, but I suspect they\u2019re going to look a bit different moving forward.\u201d<\/p>\n<\/blockquote>\n<p>In the Q2 2023 Report, Ripple focused on the SEC v Ripple case, the Court ruling in programmatic sales, and misconceptions. The report stated,<\/p>\n<blockquote>\n<p>\u201cWhile published in a good faith effort at transparency, these quarterly reports have been weaponized against the Company by the SEC. Ironic for an agency that touts transparency and disclosure.\u201d<\/p>\n<\/blockquote>\n<p>In response to the SEC <a href=\"https:\/\/www.fxempire.com\/forecasts\/article\/xrp-bulls-to-target-0-65-on-sec-early-appeal-prospects-1367326\">motion<\/a> for leave to file an interlocutory appeal, Ripple Chief Legal Officer Stuart said,<\/p>\n<blockquote>\n<p>\u201cThe SEC does not have the right to appeal just yet, which is why they are asking permission to file an interlocutory appeal. Ripple will file its response with the Court next week. Stay tuned.\u201d<\/p>\n<\/blockquote>\n<p>Investors will await the Ripple response to the motion that could come as early as today.<\/p>\n<p>Judge Torres will then rule on the motion, with uncertainty over the Court decision leaving XRP in limbo. This will then allow her to even more fully explain her reasoning and to also further make it appeal-proof.
